General Terms and Conditions - Zorgeloos onder de Zon<\/h2>\t\t\t\t<\/div>\n\t\t\t\t

<\/strong><\/p>

  1. Definitions<\/strong><\/li><\/ol>

    In these general terms and conditions, the following definitions shall apply:<\/p>

    • Zorgeloos onder de Zon<\/strong>: trade name of Chapter IV, having its registered office in the Netherlands, registered with the Chamber of Commerce under number 96255765.<\/li>
    • Customer<\/strong>: any natural or legal person using the services of Zorgeloos onder de Zon.<\/li>
    • Service<\/strong>: all forms of service provided by Zorgeloos onder de Zon, including but not limited to coordination, advice, arrangements, service packages and mediation with partners.<\/li>
    • Partner<\/strong>: a third party approved by Zorgeloos onder de Zon (such as estate agents, contractors, installers, maintenance companies or legal advisors) that performs services for or on behalf of clients.<\/li><\/ul>
      1. Applicability<\/strong><\/li><\/ol>

        These terms and conditions apply to all offers, agreements, work and provision of services by Zorgeloos onder de Zon, unless otherwise agreed in writing.<\/p>

        1. Nature of service<\/strong><\/li><\/ol>

          3.1 Zorgeloos onder de Zon is not an estate agent, broker, gestor, notary, contractor or legal advisor. We act solely as coordinator and facilitator, providing access to a network of approved partners.<\/p>

          3.2 Our services include:<\/p>

          • guidance on buying and selling processes;<\/li>
          • coordination of and mediation with recognised partners;<\/li>
          • assistance with regulatory issues such as utilities, insurance, permits and maintenance;<\/li>
          • emergency service and help with arranging practical matters through service packages.<\/li><\/ul>

            3.3 The final execution of specialised services is always done by partners or external parties. Zorgeloos onder de Zon has a coordinating and facilitating role in this.<\/p>

            1. Partners and responsibility<\/strong><\/li><\/ol>

              4.1 Zorgeloos onder de Zon carefully selects partners based on experience, reliability and adherence to partner guidelines.<\/p>

              4.2 The client enters into contracts for specific work (such as construction, legal advice or installations) directly with the partner. The partner is responsible for the quality and performance of these services.<\/p>

              4.3 Zorgeloos onder de Zon is not liable for errors, shortcomings or damages caused by partners or third parties.<\/p>

              1. Liability<\/strong><\/li><\/ol>

                5.1 Zorgeloos onder de Zon endeavours to perform its services to the best of its knowledge, expertise and ability.<\/p>

                5.2 All advice and coordination is given based on the information and regulations available at the time. We do not guarantee any particular result.<\/p>

                5.3 Zorgeloos onder de Zon is not liable for damages resulting from, among other things:<\/p>

                • changes in laws and regulations, in Spain or elsewhere;<\/li>
                • errors of or delays at partners, notaries, banks or government agencies;<\/li>
                • price increases or third-party supply problems;<\/li>
                • disappointment in the outcome of services or products provided by partners.<\/li><\/ul>

                  5.4 Any liability of Zorgeloos onder de Zon is limited to the amount paid by the customer for the relevant service or package, with a maximum of \u20ac1,000.<\/p>

                  1. Packages and prices<\/strong><\/li><\/ol>

                    6.1 Zorgeloos onder de Zon services are offered in the form of service packages or bespoke arrangements.<\/p>

                    6.2 All prices include VAT unless otherwise stated.<\/p>

                    6.3 Zorgeloos onder de Zon reserves the right to adjust prices based on market developments, inflation or changes in its cost structure.<\/p>

                    6.4 Price changes will be communicated to the customer at least 30 days in advance.<\/p>

                    1. Duration and termination<\/strong><\/li><\/ol>

                      7.1 A service package is concluded for a minimum term of 12 months, unless expressly agreed otherwise.<\/p>

                      7.2 After the initial contract period, the package can be cancelled monthly, with a notice period of one calendar month.<\/p>

                      7.3 Upon termination of the package, the benefits and services associated with the package will expire.<\/p>

                      1. Force majeure<\/strong><\/li><\/ol>

                        Zorgeloos onder de Zon is not obliged to fulfil obligations if it is prevented from doing so by circumstances beyond its control, including as a result of natural disasters, strikes, pandemics, wars, government measures or technical failures.<\/p>

                        1. Applicable law and disputes<\/strong><\/li><\/ol>

                          All legal relations between Zorgeloos onder de Zon and the customer are exclusively governed by Dutch law. Any disputes will be resolved in mutual consultation whenever possible.
